As a landlord participating in the Section 8 Housing Choice Voucher Program of the Tooele County Housing Authority (TCHA), I understand that I will have the following responsibilities:
- To comply with all requirements contained in the Assisted Lease, Tenancy Addendum and Housing Assistance Payment (HAP) Contract, with special emphasis on maintaining the unit in a decent, safe and sanitary condition to meet the HUD Housing Quality Standards.
- To collect only the amount of rent from the tenant that is specified in the Assisted Lease.
- To notify the TCHA in writing if I intend to evict a tenant, provide a copy of the eviction notice, and to comply with state and local eviction procedures
- To notify the TCHA immediately if the tenant vacates the unit.
- To notify the TCHA and the tenant at least 60 days prior to a rent increase. However, rent cannot increase within the initial term of the lease and contract.
- To provide my Social Security or Tax I. D. number in order to receive rental payments.
- On my lease, under Conditions and Terms, write: “The HUD Tenancy Addendum is hereby made a part of this lease,” and attach a copy of the lease to this document. The HUD Tenancy Addendum will be issued with the Housing Authority’s contract. You may view the HUD Tenancy Addendum in the attachment below.
- I am not the parent, child, grandparent, grandchild, brother or sister of any member of the family seeking to rent the unit unless the Housing Authority has determined that approving the leasing of the unit, notwithstanding such relationship, would provide reasonable accommodation for a family member who is a person with disabilities.
- Report to the TCHA if this unit receives subsidy from any other federal housing program.
TENANCY ADDENDUM (PDF)
Under HUD’s Section 8 Housing Choice Voucher Program, the Tooele County Housing Authority pays you (owner, landlord, manager) a subsidized portion of the rent while the participating tenant pays you their portion of the rent. This portion may vary from month to month, as it is based on total household income. However, the two portions will always equal the total contracted rent amount. We mail you the subsidized portion of the rent in a check on the last day of every month or you may have it direct deposited each month.

Please be aware that:
- The term of the initial lease must be for a minimum of (1) full year and must have a beginning and ending date.
- The contract rent will remain the same for this period of time.
- The effective date of the lease will be the same as the Housing Authority Contract.
- The following must be included on the lease:
- Adult Tenants and Owner Names
- Unit Address, including City, State, Zip code
- Proposed term of the lease, not less than one year
- Landlords expected renewal arrangement at the end of the lease
- Amount of Rent
- Who pays utilities; Electricity, Gas, Water, Sewer, and Garbage
- Who supplies major appliances (stove, refrigerator, garbage disposal, dishwasher, etc.)
W-9 Form and Cover Letter
To participate in this program, you must complete, sign and return a W-9 (with it’s cover letter), a Request for Tenancy Approval and a proposed lease (signed or unsigned) on which is written “The HUD Tenancy addendum is hereby made a part of this lease.”
Once these documents are received by the Housing Authority and checked to ensure the tenant can afford the rent (in accordance with HUD regulations), we call the tenant (and/or the landlord) to schedule an inspection.
Upon passing an inspection, we contact the tenant to come in and pick up the HUD Tenancy Addendum and Housing Assistance Payment Contract to be brought to you for signature. These documents must be returned in their entirety. After processing we will send you and the tenant the appropriate copies and release payment.
Payment begins on the first of the month following the latest of the following criteria:
- Beginning date of the lease.
- Date of passing an inspection.
- Date tenant takes possession of the unit.
As a landlord you want the best possible tenant, so we encourage you to carefully screen Section 8 clients just as you would screen other prospective renters. You will have a normal tenant-landlord relationship with your Section 8 tenants and will be the responsible party when maintenance concerns arise.
